Terms and Conditions for Chalet Booking and Use
First: Check-in and Check-out
- The
tenant (lessee) declares that he/she is over twenty-one (21) years of age
at the time of receiving the chalet.
- The
purpose of the rental is for family use only. Entry of young men
(males) unaccompanied by their families is strictly prohibited. In case of
violation, the owner/lessor has the right to deny entry and cancel the
booking without refund of any paid amounts or the security deposit.
- The
contract is valid from the check-in date until the check-out date, with
check-in at 10:00 AM and check-out at 2:00 PM.
Second: Commitment to Check-out Time
- The
tenant must vacate the chalet no later than 2:00 PM.
- In
case of delay, a penalty of twenty-five Kuwaiti Dinars (KWD 25) per hour
will be applied and deducted directly from the security deposit.
- The
tenant shall return the rented premises with all its contents (facilities,
furniture, appliances, etc.) in the same condition as received.
- The
tenant acknowledges having inspected the premises upon delivery,
confirming its condition and suitability for use, and receiving the
swimming pool clean.
Third: Advance Payments, Cancellation, and No-show
- If the
tenant vacates the premises before the end of the contract, he/she remains
liable for the full rental value of the agreed period.
- For
cancellations made less than one (1) week prior to check-in, 50% of the
total amount paid will be deducted.
- For
cancellations made two (2) weeks or more prior to check-in, 30% of the
total amount paid will be deducted.
- If
only a down payment (deposit) was made and the balance is not paid ten
(10) days before check-in, the entire deposit (100%) will be forfeited.
- The
tenant must notify the owner immediately of any malfunctions or defects in
sanitary or electrical equipment for necessary repairs.
Fourth: General Conditions of Use
- It is
prohibited to store any illegal or flammable materials inside the
premises. Only officially approved decorative materials may be used. The
tenant is fully liable for any fire or damage occurring inside the chalet
for any reason.
- No
animals or birds, whether domestic or wild, are allowed inside the chalet
or its facilities.
- Parties
or gatherings exceeding the chalet’s capacity are strictly prohibited.
Violation results in automatic termination of the contract without notice.
- Neighbors
must be respected; noise and disturbance are prohibited. The tenant is
responsible for cleanliness, safety, and any damages caused by him/her or
accompanying persons.
- The
tenant bears full responsibility for any accidents, injuries, or deaths
(God forbid) inside or resulting from use of the swimming pool. The owner
is fully discharged of liability.
- This
contract is governed by Law No. 35 of 1987 on real estate leasing and its
amendments. Rental disputes fall under the jurisdiction of the Kuwaiti
Rent Courts.
- The
contract is automatically terminated without warning if the tenant
breaches any condition, and the owner has the right to immediate eviction
without compensation.
Fifth: Security Deposit
- The
tenant shall pay the security deposit amount specified in the booking
invoice. This deposit must be paid ten (10) days before check-in, and the
contract is not valid until full payment is made.
- The
deposit will be refunded within three (3) to fourteen (14) days after
check-out, after deducting any amounts for damages or losses during the
stay.
Sixth: Additional Obligations of the Tenant
- The
tenant shall maintain the cleanliness of the chalet and all its
belongings.
- The
tenant shall respect the privacy and comfort of neighbors and bears full
legal responsibility in case of any complaints, with no liability on the
owner.
- The
tenant shall maintain quietness and comply with all laws and regulations
in Kuwait. The company has the right to evict the tenant using legal force
if necessary, without refund of any amounts, even if the rental period has
not been completed.
- Gatherings
or parties exceeding the chalet’s capacity, or in violation of public
health regulations, are strictly prohibited. Violation results in
immediate eviction without liability on the company.
- The
purpose of the lease is family use only; any other use contrary to the
policies of "Shalehna" Company is prohibited.
Seventh: Force Majeure Cancellations
- The
tenant may only cancel in the event of death (God forbid), provided
official proof is submitted. In this case, the booking may be postponed to
a later available date, with no refund.
- For
cancellations due to any other reason, no refund will be given, whether
for deposit or full payment.
- The
tenant releases the company from any responsibility regarding refunds and
acknowledges that refunds are only possible in the cases mentioned above,
and only in the form of rescheduling.
Eighth: Additional Special Obligations
- Upon
discovering any malfunction, breakage, or damage inside the chalet or its
facilities, the tenant must immediately take photographs and notify the
booking officer. Failure to do so makes the tenant fully liable for any
damages discovered after check-out.
- Before
using the swimming pool, the tenant must inquire with the booking officer
about any requirements or special instructions and fully comply with them.
The tenant bears full responsibility in case of violation.
- The
tenant is obliged to ask the booking officer about any matter or use not
mentioned in this contract or in the terms and conditions. Failure to
inquire shall be deemed implicit acceptance of full responsibility for any
violation or misunderstanding.
