Important Notice:
Due to the current circumstances in the country, completing a reservation means that the client fully agrees to bear complete responsibility for the booking. In the event of paying a deposit or the full amount, the payment is non-refundable. The reservation may be postponed only once, subject to availability. Completing the booking is considered explicit acceptance of these terms and conditions.
Terms and Conditions for Booking and Using the Chalet
First: Check-in and Check-out Time
The second party (the tenant) acknowledges that they are over twenty-one (21) years of age at the time of receiving the chalet.
The rental is strictly for family use only. Entry of unaccompanied men (youth groups) is strictly prohibited. In case of violation, the first party (owner/lessor) has the right to deny entry and cancel the booking without refund of any paid amounts or security deposit.
The contract is valid from the check-in date until the check-out date. Check-in time is from 10:00 AM, and check-out is at 2:00 PM.
Second: Compliance with Check-out Time
The tenant must vacate the chalet no later than 2:00 PM.
In case of delay, a penalty of twenty-five Kuwaiti Dinars (25 KWD) per hour will be applied and deducted directly from the security deposit.
The tenant must return the rented property with all its contents (facilities, decorations, appliances, etc.) in the same condition as received.
The tenant acknowledges that they have inspected the property upon handover, approved its condition, and received the swimming pool clean and ready for use.
Third: Advance Payments, Cancellation, and No-show
If the tenant vacates the property before the end of the contract period, they are obligated to pay the full rental amount for the agreed duration.
If the booking is canceled less than one week before check-in, 50% of the total paid amount will be deducted.
If the cancellation is made two weeks or more before check-in, 30% of the total paid amount will be deducted.
If only a deposit is paid and the remaining balance is not completed at least ten (10) days before check-in, the full deposit (100%) will be forfeited.
The tenant must immediately notify the first party of any malfunctions in sanitary or electrical systems for prompt repair.
Fourth: General Conditions for Use of the Property
It is strictly prohibited to bring any illegal or flammable materials into the property. Only approved decorative materials may be used. The tenant bears full responsibility for any fire or damage occurring for any reason.
Animals and birds, whether domestic or otherwise, are strictly prohibited داخل the chalet and its facilities.
Hosting parties or gatherings exceeding the chalet capacity is strictly prohibited. Violation of this condition results in immediate termination of the contract without prior notice.
Neighbors must be respected. Any noise or disturbance is prohibited. The tenant is responsible for the cleanliness and safety of the property and any damage caused by them or their guests.
The tenant bears full responsibility for any injuries, accidents, or fatalities (God forbid) occurring داخل or due to the use of the swimming pool. The owner bears no responsibility.
This contract is governed by Law No. (35) of 1987 regarding real estate leasing and its amendments. Rental courts in the State of Kuwait have jurisdiction over any disputes arising from this contract.
The contract shall be automatically terminated without notice in case of any breach by the tenant, and the owner has the right to immediate eviction without compensation.
Fifth: Security Deposit
The tenant must pay the security deposit specified in the booking invoice. This deposit must be paid at least ten (10) days before check-in, and the contract is not considered valid without full payment.
The deposit will be refunded within a period of three (3) to fourteen (14) days after check-out, after deducting any amounts for damages incurred during the stay.
Sixth: Additional Obligations of the Tenant
The tenant must maintain the cleanliness of the chalet and all its belongings.
The tenant must respect the privacy and comfort of neighbors and bears full legal responsibility for any complaints, without any liability on the owner.
The tenant must maintain quietness and comply with all laws and regulations in the State of Kuwait. The company has the right to evict the tenant by force if necessary in case of violation, without refund.
Gatherings or parties exceeding the chalet capacity or violating public health regulations are strictly prohibited and will result in immediate eviction without liability on the company.
The rental is strictly for family use only, and any other use is prohibited according to the company “Chalethna” policies.
Seventh: Force Majeure Cancellation Cases
The tenant may only cancel the reservation in the case of death (God forbid), provided that official proof is submitted. In such cases, the booking will be postponed to a later date subject to availability, without refund.
In any other case of cancellation, no amounts paid (deposit or full payment) will be refunded.
The tenant releases the company from any liability regarding paid amounts and acknowledges no entitlement to refunds except in the stated force majeure case, and only in the form of rescheduling.
Eighth: Additional Special Obligations
The tenant must immediately photograph and report any damage, breakage, or defects داخل the chalet or its facilities to the booking officer upon discovery to avoid being held responsible. Failure to do so will result in full financial liability for any damages discovered after check-out.
Before using the swimming pool, the tenant must inquire about any specific instructions or conditions from the booking officer and fully comply with them. The tenant bears full responsibility in case of violation.
The tenant must consult the booking officer regarding any matter or usage not mentioned in these terms and conditions. Failure to do so is considered implicit acceptance of full responsibility for any misuse or misunderstanding.
